Democrats swept Congress in the 2026 US midterms. I will tell you what changed and what happens next. The new Congress takes over in January, and that shift could reshape crypto law.

In this article: what happened, the numbers, what changes in January, what it means for crypto law, what stays the same, and what I am watching next.

The direct answer

Democrats won control of both chambers in the midterm elections held on 3 November 2026. The Associated Press reported it. The new Congress is due to take over in January. It will be sworn in on 3 January 2027. Until then, Republicans keep their majorities, and President Trump keeps his veto. The counts were still moving, and some races remained uncalled. I will not present any count as a final certified result.

What happened

Voters went to the polls on 3 November 2026. The Associated Press reported that Democrats won control of both chambers. As of 1:30 a.m. Eastern time on Wednesday, Democrats had flipped 16 House seats and seven Senate seats from Republicans, citing Associated Press tallies. They needed a net gain of three seats in the House and four in the Senate. Democrat Sherrod Brown beat Republican Senator Jon Husted in Ohio. That win also matters for crypto law, and I explain why below.

The House and Senate in numbers

The counts were still moving, and sources took their snapshots at different times. That is why the numbers differ.

The Associated Press page for the election date of 2026-11-03 gave this US House picture: Democrats 235 won, Republicans 146 won, Democrats leading 26, Republicans leading 28, 435 districts, 218 seats needed for a majority. Before the election, Democrats held 215 seats, Republicans held 219 seats, and Others caucus with GOP held 1 seat. Precincts reporting stood at 77.78%.

Cointelegraph, published on 2026-11-05, gave a different snapshot. It said that at the time of writing, Democrats had secured 228 House seats to Republicans’ 139, with 68 races still uncalled, according to the Associated Press. Its Senate tally was 54 seats for Democrats and 44 for Republicans.

EconoTimes, published on 2026-11-05, said Senate Democrats held at least 54 of 100 seats and their House majority was above the 218 seats needed for control, with some races still uncalled.

What changes in January

The new Congress is due to take over in January and will be sworn in on 3 January 2027. That date is the real turning point. After that date, Democrats hold the gavels in both chambers.

That change means new chairs, new agendas, and new control over which bills move. A party that controls both chambers can set the schedule. Until then, Republicans keep their majorities.

What it means for crypto law

The result could derail the CLARITY crypto market structure bill, according to Stefan Muehlbauer, head of US government affairs at CertiK. I quote his view as his view only. He said: “The immediate read on this election result is that CLARITY bill is likely dead.”

The House approved H.R. 3633, the Digital Asset Market Clarity Act, by a 294-134 vote in July 2025. On Sept. 15, 2026, 49 senators backed cloture on a motion to proceed to the bill, 50 opposed it and one did not vote. The tally addressed whether the motion could advance, not whether the bill would pass.

Our earlier report on the CLARITY Act failure and the SEC and CFTC crypto regulation debate covered the earlier CLARITY failure. This election adds a new political cause to that story.

Elizabeth Warren is in line to chair Senate Banking, and Sherrod Brown could chair Senate Agriculture, which oversees the CFTC. Our report on the CFTC first federal crypto trading rules gives background on why the CFTC role matters.

One law stays in force. The GENIUS Act, the stablecoin law passed in July 2025, stays in force. For market context, read our report on Bitcoin holding 83k after 2.4 billion in liquidations and our report on the Fed rate decision in October 2026 and CPI inflation.

What stays the same until January

Until the new Congress is sworn in on 3 January 2027, Republicans keep their majorities. President Trump keeps his veto. The election result is real, but its power starts in January. The GENIUS Act stays in force, and the CLARITY bill stays where it was until the new Congress acts. What I am watching next

I am watching three things: the final certified counts, the CLARITY bill, and the new chairs. Muehlbauer said the bill is likely dead, and that is his view. Elizabeth Warren is in line to chair Senate Banking, and Sherrod Brown could chair Senate Agriculture, which oversees the CFTC.

How many Senate seats did Democrats hold in the early tallies?

Cointelegraph gave 54 seats for Democrats and 44 for Republicans. EconoTimes said Senate Democrats held at least 54 of 100 seats. Some races remained uncalled.

Does the GENIUS Act still apply after the election?

Yes. The GENIUS Act, the stablecoin law passed in July 2025, stays in force.

Final thoughts

I felt the weight of this result as I read the early tallies. An election can feel far away, but its outcome reaches into real lives and real rules for crypto. I do not know yet how the new Congress will use its power. I know the counts were still moving, I know January is the turning point, and I know the CLARITY bill now faces a harder path. I will keep watching, and I will keep telling you what the sources actually say.
